1. Acceptance of These Terms

Welcome to Taotubao (the "Service"), accessible at taotubao.cn and video.taotubao.cn. By registering for, accessing, or using the Service, you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. Description of the Service

Taotubao is a content production tool for e-commerce sellers. The Service allows you to upload your own design materials (such as product patterns and images), select templates, and generate product photo sets and short videos. The Service also offers an optional feature that lets you post the videos you have created to your own TikTok account through TikTok's official developer interfaces, after you explicitly confirm each posting in the app.

3. Accounts and Eligibility

• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.
• You are responsible for the accuracy of your registration information and for keeping your account credentials secure. All actions taken under your account are deemed to be taken by you.

4. User Content and Ownership

• You retain all ownership rights in the materials you upload ("User Materials") and in the photo sets and videos generated from them ("Generated Content").
• You grant the Service a limited, revocable license to store, process, and render your User Materials solely as necessary to provide the Service, including delivering generated files to you and, where you have explicitly requested it, transferring a Generated Content file to TikTok on your instruction.
• You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions for the User Materials you upload, and that uploading and processing them through the Service does not infringe any third party's rights, including copyright, trademark, portrait rights, or trade secrets.

5. Posting Content to TikTok

• The TikTok posting feature is optional and is performed only on your explicit instruction. Before any content is transferred to TikTok, the Service presents you with the intended post settings (including privacy level and disclosure options) and requires your explicit confirmation.
• You may only connect TikTok accounts that you own or are authorized to operate. You are solely responsible for the content you post, for complying with TikTok's Terms of Service and Community Guidelines, and for any commercial content disclosures required by applicable law or TikTok policy.
• The Service does not guarantee that TikTok will accept, publish, or keep any posted content, and it is not responsible for any actions TikTok may take with respect to your account or content.

6. Acceptable Use

You agree NOT to:

• upload materials that are illegal, infringing, pornographic, or that violate any third party's rights;
• use the Service to spam, to mass-post content you did not create, or to post content to accounts you are not authorized to use;
• reverse engineer, scrape, resell, or interfere with the Service or its infrastructure;
• use the Service for any unlawful purpose or in violation of any applicable law or regulation.

7. Third-Party Services

The Service relies on third-party providers, including cloud storage and computing providers for hosting your materials and Generated Content, and TikTok's developer interfaces for the optional posting feature. Your use of TikTok features is additionally governed by TikTok's own terms and policies.

8. Fees and Quotas

Certain features of the Service may be provided on a trial-quota, prepaid, or subscription basis. We will present applicable fees and quotas before charging. Unless stated otherwise, fees already paid are non-refundable. We may adjust pricing prospectively with reasonable notice.

9. Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, the operator of the Service shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities, arising from or related to your use of the Service. In no event shall the operator's total liability exceed the fees you paid to the Service in the twelve (12) months preceding the claim.

10. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate your account if you materially breach these Terms or if your use of the Service creates legal or security risk. Upon termination, your stored materials will be handled in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a new effective date. Continued use of the Service after an update constitutes acceptance of the updated Terms.

二、服务说明

套图宝是面向电商卖家的内容生产工具。本服务允许你上传自己的设计素材（如产品图案、图片），选择模板，批量生成产品套图与短视频。本服务还提供可选功能：在你于应用内逐次明确确认后，通过 TikTok 官方开发者接口，将你生成的视频发布到你自己授权的 TikTok 账号。

三、账号与使用资格

• 使用本服务须年满 18 周岁或达到你所在司法辖区的法定成年年龄。
• 你应保证注册信息真实准确，并妥善保管账号凭据。账号项下的一切操作均视为你本人操作。

四、用户内容与权属

• 你上传的素材（"用户素材"）以及由其生成的套图与视频（"生成内容"）的所有权归你所有。
• 你授予本服务一项有限的、可撤销的许可，仅用于存储、处理、渲染你的用户素材以提供本服务，包括向你交付生成文件，以及在你明确指示时将生成内容文件传输至 TikTok。
• 你保证对上传的用户素材拥有全部必要的权利、许可与授权，上传及处理该等素材不会侵犯任何第三方的著作权、商标权、肖像权、商业秘密等合法权益。

五、发布内容至 TikTok

• TikTok 发布功能为可选功能，仅在你明确指示后执行。任何内容传输至 TikTok 前，本服务会向你展示该次发布的设置（包括隐私级别与披露选项），并要求你明确确认。
• 你只能绑定你本人拥有或经授权运营的 TikTok 账号。你对发布的内容独自负责，包括遵守 TikTok 服务条款与社区准则，以及适用法律或 TikTok 政策所要求的商业内容披露义务。
• 本服务不保证 TikTok 接受、发布或保留任何已提交的内容，亦不对 TikTok 就你的账号或内容采取的任何措施承担责任。

六、禁止行为

你承诺不进行下列行为：

• 上传违法、侵权、色情或侵犯他人权益的素材；
• 利用本服务发送垃圾信息、批量发布非本人创作的内容，或向未经授权的账号发布内容；
• 对本服务进行逆向工程、抓取、转售或干扰其基础设施；
• 将本服务用于任何非法目的或违反适用法律法规的用途。

七、第三方服务

本服务依赖第三方服务，包括用于托管素材与生成内容的云计算与存储服务商，以及用于可选发布功能的 TikTok 开发者接口。你对 TikTok 功能的使用还须遵守 TikTok 自身的条款与政策。

八、费用与额度

本服务的部分功能可能以体验额度、预付费或订阅方式提供。收费前我们会展示相应的费用与额度标准。除另有说明外，已支付费用不予退还。我们可提前合理通知后调整价格。

九、免责声明与责任限制

本服务按"现状"与"现有"基础提供，不作任何明示或默示的保证。在法律允许的最大范围内，本服务运营方不对因使用本服务产生的任何间接、偶然、特殊、后果性或惩罚性损害，以及利润、数据或商机的损失承担责任。运营方的累计赔偿责任以你在索赔前十二个月内支付的费用总额为上限。

十、中止与终止

你可以随时停止使用本服务。如你严重违反本条款，或你的使用行为构成法律或安全风险，我们可中止或终止你的账号。终止后，你存储的素材将按照隐私政策处理。

十一、条款变更

我们可能不时更新本条款，并在本页面发布更新后的版本及新的生效日期。更新后继续使用本服务即视为接受更新后的条款。
